HSV Junior Golf Rent-to-Buy Purchase Agreement

 

Statement: The HSV Junior Golf Program has determined that our beginner junior golfers would benefit from clubs that are more appropriate for their entry level of play than clubs previously provided through donated clubs that were modified to meet their height requirements.  Therefore, the directors of the HSV Junior Golf program have agreed to offer a rent-to-buy program whereby our entry level golfers will be furnished with a marketed set of clubs specific to their needs enhancing their golfing experience. Furthermore, the previously furnished modified clubs will no longer be available for our entry level golfers.

Details:

• If a player’s height does not exceed 58 inches, they will receive a junior set of clubs.  (If over 58″, modified adult sets of clubs will be issued.)
• The initial cost of the clubs will be $50.
• This cost will enable the golfers to use the clubs for the summer session beginning June 1^st through July 31^st.
• At the end of the summer session, or before, the players are required to return the set of clubs OR apply the initial cost, $50, towards the purchase of the set of clubs for a total price of $170.00. (an additional $120.00) Additionally,  registered golfers may purchase the clubs for $170 at any time.
• Trade options are not available for this agreement.

 Lost or Damaged Clubs:

The player’s Sponsor, Parent, Grandparent or Guardian agrees to pay to the HSV Junior Program the value of any lost or damaged clubs and/or equipment furnished as part of the set. Normal wear and tears (scratches on the bottom of the club heads and/or tee marks) are not recognized as damaged.

Waiver of Liability and Indemnity:

• I,  __Sponsor, Parent, Grandparent, or Guardian__, as the junior golfer’s sponsor agree that in consideration of being permitted to use HSV Junior Golf (“Owner”) golf clubs & other golf equipment at any time during the current golf season and do hereby release, waive, discharge, and covenant not to sue Owner, its members, employees, and agents from liability from any and all claims, including the negligence of Owner, resulting in personal injury, accidents or illnesses, including death, and property loss arising from use of the rented clubs.

Indemnification and Hold Harmless: I also agree to defend, indemnify, and hold harmless the Owner, its members, employees, and agents from and against any and all claims, demands, actions, or causes of actions for costs, attorney’s fees, expenses, or damages to personal property, or personal injury, or death, which may result from any use of the Clubs.
